Whether you agree with the Mormon position or not, these protesters are using their rights under the First Amendment of the Constitution to try to deny Mormons THEIR First Amendment rights. In fact the First Amendment not only guarantees free speech but also freedom to express religious belief. It Reads:

Amendment 1 - Freedom of Religion, Press, Expression. Ratified 12/15/1791.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble

There is no expression of separating religious belief from the State, just the prohibition of the State establishing a religion as was done in England with the King as head of the Anglican Church with the requirement that English citizens be members.

The commonly used term "separation of church and state" is attributed to Thomas Jefferson who believed that Christian principles were the foundation of our State, but that there should be no official denomination endorsed by the State.

Mormons were not the only church for Prop 8 and in fact were not the largest church in favor of the proposition. That honor belongs to the Catholic church. It is generally recognized though that the passage of Prop 8 can be correlated to the large turnout of black voters who were voting in favor of Barrack Obama. A very large percentage of black voters (70%) voted for Prop 8 while only 50% of whites voted for the measure. It is also widely known that the Mormon church has one of the lowest percentages of black members of any denomination. Blaming the Mormon vote for the passage of this proposition then is clearly in error. As for the money involved, the Mormon and Catholic churches along with Muslim and Protestant congregations encouraged their members to join secular campaigns where members of all faiths and some non believers worked together and raised funds in support of the measure. It was then these organizations, not the churches that worked to pass the measure
